Simplified Divorce in California

Pleasanton CA divorce attorneyWhen kids are involved, or when a couple can’t agree on matters such as child custody and alimony, divorce proceedings can quickly become contentious, drawn out affairs. This turns the process into a rather costly and draining affair.

Of course, the inverse is also true. If a couple that is seeking to get divorced is in agreement, they can choose to pursue a simplified divorce, which is known as a summary dissolution. Unlike traditional divorce proceedings, a summary dissolution carries many benefits and is the quickest, most efficient way to get a divorce. That said, couples need to fulfill certain requirements before they can be eligible for a simplified divorce.

Eligibility for Summary Dissolution

The requirements for summary dissolution include several stipulations. For one, there must be no minor children involved. In addition, the marriage must have taken place within the last five years, and the reason for the divorce must involve irreconcilable differences. Other stipulations require that both parties sign a settlement agreement, waive their right to alimony, and one spouse must have been a California resident for at least six months prior to the pursuit of a summary dissolution.

How the Process Works

Once both spouses have filed a joint petition for a summary dissolution and other related paperwork such as the settlement agreement, the petition is brought forward to the court. Provided that everything looks good, the court then issues a judgement of dissolution, which places the divorce into effect six months after this judgement is issued. After that, either party is fully divorced and free to remarry.
